TERMS AND CONDITIONS OF SALE
GOW – GODDESS OF WORKOUT
Last updated: October 22, 2026

1. SELLER IDENTITY

The website goddessofworkout.com is operated by a sole trader (EI) trading under the name Goddess of workout.
Address: 186 Chemin en Ramet, 38570 La Pierre, France.
SIRET: 80806369700029
Email: contact@goddessofworkout.com

In these terms, “GOW” means the seller and “the customer” means the consumer placing an order on the website.

2. PURPOSE AND SCOPE

These terms and conditions of sale govern purchases of clothing and accessories made on goddessofworkout.com by consumers for their personal needs.

They are available before the order is confirmed and can be saved or printed.

The applicable version is the one in force on the date of the order. Any later change does not affect orders already placed.

For sales to consumers, these terms prevail over any conflicting provision of the website’s terms of use or terms of service, without limiting the consumer’s mandatory rights.

3. PRODUCTS AND AVAILABILITY

The essential characteristics of the items are presented on their product page, including their description, sizes, colours and composition.

Photographs illustrate the items offered. Colours may vary slightly depending on the screen, but this does not allow an item different from the stated characteristics to be delivered.

Offers are valid while stocks last or, for pre-orders, within the quantities offered.

If an item turns out to be unavailable after the order, GOW will promptly inform the customer. No substitute item is imposed. Amounts for unavailable items and any shipping costs that no longer apply are refunded without undue delay.

4. PRICES

Prices are shown in euros and are the final price of the items, including applicable taxes, excluding shipping costs, which are shown separately.

The total amount payable, including items and shipping costs, is shown before the order is finally confirmed.

Prices may change for future orders. The applicable price remains the one displayed at the time of the order.

The terms and duration of promotions are stated in the relevant offers.

5. ORDERS

The customer selects the items, their variants and the desired quantities, then adds them to the cart.

Before confirming, the customer can check the cart contents, the total amount, the address and other information entered, and correct any errors.

Final confirmation of the order entails an obligation to pay and acceptance of these terms.

Subject to payment authorisation, the sale is concluded when the order is finally confirmed. A confirmation is sent to the customer by email.

The customer must provide accurate details, in particular for delivery and for receiving messages about the order.

GOW may only refuse or cancel an order for a legitimate reason, in particular a declined payment or proven fraud, while respecting consumer rights. Any amount collected for an order cancelled by GOW is refunded.

6. PAYMENT

The available payment methods are shown at checkout.

Unless other terms are expressly offered before the order, the total price is payable when ordering, including for pre-order items.

The customer must be authorised to use the chosen payment method. The order cannot be fulfilled if payment is declined.

Payment processing is handled by the providers offered in the payment interface.

7. PRE-ORDERS

When an item is offered for pre-order, this is stated on its product page before purchase.

A delivery date or period is communicated before the order is confirmed. A shipping date alone does not replace information about the delivery period.

For an order combining available items and pre-order items, grouped or separate delivery arrangements are stated before purchase.

In the event of a delay, GOW informs the customer. Any change to the initial period does not deprive the customer of their rights, in particular the right to request termination of the sale under the legal conditions.

A pre-order of a standard garment carries the right of withdrawal. It does not, on its own, constitute a personalised order.

8. DELIVERY

The destinations served, shipping methods, their costs and applicable delivery times are shown on the website and at checkout, before the order is confirmed.

GOW delivers the items to the address given by the customer within the agreed period. If no date or period has been agreed, delivery takes place without undue delay and no later than thirty days after the contract is concluded.

If the period is exceeded, the customer may ask GOW in writing to deliver within a reasonable additional period. If delivery does not take place within that period, the customer may terminate the contract in writing.

The customer may terminate the contract immediately if GOW refuses to deliver, if it is clear that delivery will not take place, or if meeting the date was an essential condition of the contract under the conditions provided by law.

If the contract is terminated for failure to deliver, the sums paid are refunded within fourteen days of termination.

GOW remains the customer’s point of contact for any lost, damaged or undelivered parcel. The customer does not need to obtain compensation from the carrier to assert their rights against GOW.

The risk of loss or damage passes to the customer when they take physical possession of the items, or when a third party designated by them, other than the carrier, takes possession. The legal exception applies when the customer chooses, on their own initiative, a carrier not offered by GOW.

The customer is invited to report any delivery problem to contact@goddessofworkout.com. Not noting any reservations on receipt does not remove their legal guarantees.

9. RIGHT OF WITHDRAWAL

The customer has fourteen days to notify their decision to withdraw, without giving any reason.

The period starts the day after the items are received. For several items ordered in a single order and delivered separately, it starts the day after the last item is received.

If the period ends on a Saturday, Sunday or public or non-working holiday, it is extended until the next working day.

This right also applies to discounted items, sale items and pre-orders of standard products.

The customer may notify their withdrawal by a clear statement:
• by email to contact@goddessofworkout.com;
• by post to Franck MONPERT – Goddess of workout, 186 Chemin en Ramet, 38570 La Pierre, France.

The form at the end of these terms may be used, but it is not mandatory.

Withdrawal requires no justification, no prior authorisation from GOW and no customer account.

Simply returning a parcel or refusing delivery, without a statement of withdrawal, is not sufficient.

10. RETURN OF ITEMS AND COSTS

The customer must return the items no later than fourteen days after notifying their withdrawal, to:
Goddess of workout
186 Chemin en Ramet
38570 La Pierre
France.

The direct cost of returns for a change of mind, size or colour is borne by the customer.

When the customer uses a label provided by GOW, a contribution of €3.90 per parcel returned with that label is deducted from the refund.

If the customer chooses their own carrier, they pay the return costs directly. No additional €3.90 deduction is then applied.

Items may be tried on to the extent necessary to check their nature, characteristics and size.

They must be protected for transport and, as far as possible, returned with their original accessories, tags and packaging. The absence of the original packaging or a tag is not, on its own, grounds for automatic refusal.

The customer may be held liable for any loss of value resulting from handling beyond what is necessary to try the items on. Any deduction must reflect an actual loss of value and be justified.

The return costs applicable to withdrawal do not apply to handling a lack of conformity or an item error attributable to GOW.

11. REFUND AFTER WITHDRAWAL

GOW refunds the sums due without undue delay and no later than fourteen days after being informed of the withdrawal.

The refund may be withheld until the items have been received back or until proof of their shipment has been provided, whichever is earlier.

It is made using the original payment method, unless the customer expressly agrees to another method at no cost to them. No store credit is imposed.

If the entire order is withdrawn, the initial shipping costs are refunded up to the cost of the cheapest standard shipping method offered at purchase. The extra cost of a more expensive shipping method is not refunded.

For a partial return, shipping costs that remain necessary for the items kept are not refunded.

Return costs and any justified loss of value are handled in accordance with the previous article.

12. EXCHANGES

To request a change of size or colour, the customer can contact contact@goddessofworkout.com

Exchanges depend on availability. If a direct exchange is not possible, the customer may exercise their right of withdrawal as set out above and place a new order.

This procedure does not limit the rights applicable to faulty or non-conforming items.

13. LEGAL GUARANTEES

The items are covered by the legal guarantee of conformity and the guarantee against hidden defects.

The trader responsible for these guarantees is Franck MONPERT EI – Goddess of workout, at the details given in article 1.

To make a claim, the customer can write to contact@goddessofworkout.com describing the problem and providing the information needed to identify their purchase.

Claims under the legal guarantee of conformity are free of charge for the customer. The €3.90 return fee does not apply.

REGULATORY NOTICE ON LEGAL GUARANTEES

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

Where the sales contract provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or service throughout the planned supply period. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or service, not the date on which it appeared.

The legal guarantee of conformity requires the trader, where applicable, to provide all updates needed to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests a repair but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date the goods are replaced.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1. The trader refuses to repair or replace the goods;
2. The repair or replacement takes place after thirty days;
3. The repair or replacement causes significant inconvenience to the consumer, in particular where the consumer permanently bears the cost of collecting or removing the non-conforming goods, or the cost of installing the repaired or replacement goods;
4. The goods remain non-conforming despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer does not have to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are returned.

The rights mentioned above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund in exchange for returning the goods.

END OF REGULATORY NOTICE

14. LIABILITY

GOW is responsible for the proper performance of its contractual obligations in accordance with applicable law.

Nothing in these terms excludes or limits any liability or right that the law does not allow to be excluded or limited.

Force majeure may only be invoked under the conditions provided by law. The customer’s rights regarding delivery and refunds remain applicable.

15. PERSONAL DATA

The data needed to process orders, deliver them, provide customer service and comply with legal obligations is processed as described in the website’s Privacy Policy.

For any request about their data, the customer can contact contact@goddessofworkout.com

16. CONFIRMATION AND ARCHIVING OF THE CONTRACT

The order is confirmed by email. The contractual information and applicable terms are provided on a durable medium no later than delivery.

For any electronic contract of €120 or more, GOW keeps it for ten years from delivery, as well as for the period between its conclusion and delivery.

The customer may request access to the archived contract at contact@goddessofworkout.com, providing the information needed to identify their order.

17. COMPLAINTS AND MEDIATION

Any complaint can be sent:
by email: contact@goddessofworkout.com
by post: Franck MONPERT – Goddess of workout, 186 Chemin en Ramet, 38570 La Pierre, France.

18. GOVERNING LAW

These terms are drafted in French and governed by French law.

This choice does not deprive the consumer of the mandatory protective provisions applicable in their country of habitual residence where the rules of private international law so provide.

In the event of a dispute, the competent court is determined in accordance with the applicable legal rules. Exclusive jurisdiction of the courts of Grenoble is not imposed on the consumer.
